Agreement to Terms

By downloading, installing, or using Memoires ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

You must be at least 16 years old to use the App. If you are under the age of majority where you live, you may only use it with the consent of a parent or guardian.

Description of Service

Memoires is a personal journal application for iOS that allows you to create, store, and organize journal entries with text, photos, voice dictation, mood tracking, and location tagging. It can also scan your photo library on your device to suggest days you have not written about, and, for subscribers, rewrite an entry using an AI model. The App stores your data locally on your device and optionally syncs through your personal iCloud account.

Subscription Plans

Free Plan

The free plan allows you to create and store up to 10 journal entries (memories). All core features are available, including text editing, voice dictation, photo attachments, mood tracking, and location tagging.

Unlimited Plan

The Unlimited plan removes the memory limit and provides access to additional features. The Unlimited plan is available at the following prices:

  • Monthly: $2.99 per month
  • Annual: $19.99 per year (save 44%)

Prices are in US dollars and may vary by region based on App Store pricing. Prices are subject to change, but any changes will not affect active subscription periods.

Subscription Management

Subscriptions are managed through the Apple App Store. By subscribing, you agree to Apple's terms for in-app purchases and subscriptions:

  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your account is charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase
  • No refunds are provided for the unused portion of a subscription period

Free Trial

If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. Any unused portion of a free trial period is forfeited when you purchase a subscription.

Your Content

You own your content. All journal entries, photos, and other content you create within the App remain your property. Memoires does not claim any ownership rights over your content.

Your content is stored on your device and, if you choose, in your personal iCloud account. We do not read, analyse, or use it for any purpose other than running the App, and we never use it to train any model. The one time your content leaves your device is when you tap Refine with AI on a specific entry, which is described below and in our Privacy Policy.

Refine with AI

Refine with AI is an optional feature for subscribers. When you tap it on an entry, the text of that entry is sent to a third-party AI model, currently operated by OpenAI, which returns a rewritten version. Our Privacy Policy sets out exactly what is sent and what is not.

You should know the following before you use it:

  • The result is generated by a machine, not written or checked by a person. It may be inaccurate, may change your meaning or emphasis, and may state things you did not write. Read it before you rely on it.
  • The result replaces your text in the editor immediately. An Undo option appears for a few seconds; once it disappears, the earlier wording is not recoverable from the App.
  • You keep ownership of both the entry you wrote and the version that comes back. We claim no rights over either.
  • Nothing you write is used to train any model, ours or anyone else's.
  • The feature is subject to daily usage limits, and to the acceptable use policies of the AI provider. Do not use it to generate unlawful content.
  • The AI provider may change. If we move to a different provider we will update the Privacy Policy to say so.

Because the output is machine-generated, we do not warrant its accuracy, and it is not advice of any kind. Journalling is not a substitute for medical, psychological, legal, or financial advice, and neither is anything the AI produces.

Acceptable Use

You agree to use the App in accordance with all applicable laws and regulations. You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Attempt to gain unauthorized access to the App's systems or infrastructure
  • Use the App to infringe upon the intellectual property rights of others
  • Distribute, share, or resell the App or your subscription in violation of Apple's terms

Intellectual Property

The App, including its design, code, features, and branding, is owned by Memoires and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App on your personal devices in accordance with these Terms and the Apple App Store terms.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, Memoires and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the App.

Our total liability for any claims arising from or related to the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim, or 100 EUR, whichever is greater.

Nothing in these Terms limits liability that cannot be limited by law. That includes liability for death or personal injury caused by negligence, for fraud, and for gross negligence or wilful misconduct. If you are a consumer, your statutory rights, including the legal guarantee of conformity, apply in full and are not affected by the disclaimers above.

Data Loss

While we design the App to reliably store your data, we are not responsible for any data loss resulting from device failure, software bugs, operating system updates, iCloud service disruptions, or any other circumstances. We strongly recommend maintaining regular backups of your device through iCloud or iTunes.

Changes to the App

We may update, modify, or discontinue features of the App at any time. We will make reasonable efforts to maintain backward compatibility and preserve your data through updates.

Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected on this page with an updated effective date. If we make material changes, we will give notice in the App or on this website at least 30 days before they take effect.

Continuing to use the App after the updated Terms take effect means you accept them. If you do not agree, stop using the App and cancel any subscription.

Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or restrict your access to the App if you violate these Terms.

Governing Law

These Terms are governed by the laws of Spain. If you are a consumer resident in the European Union or the United Kingdom, this choice does not deprive you of the protection of the mandatory consumer law of the country you live in, and you may bring proceedings in your own courts.

General

  • Entire agreement: these Terms, together with our Privacy Policy, are the whole agreement between you and us about the App.
  • Severability: if any provision is found invalid or unenforceable, the rest stays in force.
  • No waiver: not enforcing a provision on one occasion does not waive it.
  • Assignment: you may not transfer your rights under these Terms without our consent. We may transfer ours, for example if the App changes hands, without affecting your rights.
