By downloading, installing, or using Memoires ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Memoires is a personal journal application for iOS that allows you to create, store, and organize journal entries with text, photos, voice dictation, mood tracking, and location tagging. The App stores your data locally on your device and optionally syncs through your personal iCloud account.
The free plan allows you to create and store up to 10 journal entries (memories). All core features are available, including text editing, voice dictation, photo attachments, mood tracking, and location tagging.
The Unlimited plan removes the memory limit and provides access to additional features. The Unlimited plan is available at the following prices:
Prices are in US dollars and may vary by region based on App Store pricing. Prices are subject to change, but any changes will not affect active subscription periods.
Subscriptions are managed through the Apple App Store. By subscribing, you agree to Apple's terms for in-app purchases and subscriptions:
If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. Any unused portion of a free trial period is forfeited when you purchase a subscription.
You own your content. All journal entries, photos, and other content you create within the App remain your property. Memoires does not claim any ownership rights over your content.
We do not access, read, analyze, or use your content for any purpose other than providing the App's functionality on your device. Your content is stored locally and, if you choose, in your personal iCloud account.
You agree to use the App in accordance with all applicable laws and regulations. You agree not to:
The App, including its design, code, features, and branding, is owned by Memoires and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App on your personal devices in accordance with these Terms and the Apple App Store terms.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Memoires and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the App.
Our total liability for any claims arising from or related to the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.
While we design the App to reliably store your data, we are not responsible for any data loss resulting from device failure, software bugs, operating system updates, iCloud service disruptions, or any other circumstances. We strongly recommend maintaining regular backups of your device through iCloud or iTunes.
We may update, modify, or discontinue features of the App at any time. We will make reasonable efforts to maintain backward compatibility and preserve your data through updates.
We may update these Terms from time to time. Any changes will be reflected on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the revised Terms.
You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or restrict your access to the App if you violate these Terms.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles.
